Accommodation Terms and Conditions
1. Acceptance of these Terms
A contract for accommodation is formed when we accept your reservation and issue a Booking Confirmation, subject to any deposit or payment condition disclosed during booking. The Booking Confirmation, these Accommodation Terms and Conditions, and any rate-specific terms shown before purchase form the accommodation contract. If a rate-specific term conflicts with these Terms, the rate-specific term prevails only for that booking and only to the extent permitted by applicable law.
2. Hotel Business Licence
Shakespeare Hotel operates under the hotel business licence issued by the Omachi Health Centre, Nagano Prefecture, under Japan’s Hotel Business Act. Licence reference: 28 Omachi Order No. 22-15.
3. Bookings and Reservations
This website allows you to check availability and make room reservations at Shakespeare Hotel directly through our online booking engine. Full or partial payment may be required at the time of booking, depending on the rate and payment options presented to you. When you make a booking, you agree to provide accurate and current information (including guest names, contact details, and payment details) and to pay all charges associated with your reservation in accordance with the rate, cancellation, and payment terms presented to you at the time of booking.
Once your booking is completed, a booking confirmation will be sent to the email address you provide (“Booking Confirmation”). If you do not receive your Booking Confirmation within twenty-four (24) hours, please contact us via our Contact page.
You must produce your Booking Confirmation at check-in, together with valid original photo identification (passport, driver’s licence, or other identification as the hotel may require). The named guest on the Booking Confirmation must be the person checking in; we reserve the right to decline check-in otherwise. Where a booking is paid by credit card, we may require presentation of the same card at or after check-in for verification purposes.
You are solely responsible for checking the accuracy and completeness of the guest names, stay dates, room type, occupancy, contact information, and all other details in your Booking Confirmation. You must notify us promptly of any error. We are not responsible for loss caused by inaccurate or incomplete information supplied by you, and we are not obliged to change, cancel, or refund a booking except as stated in the applicable rate conditions or required by law.
The primary guest named on a booking, who is responsible for the reservation and must check in, is required to be at least 18 years old. Children of all ages are welcome to stay when accompanied by this adult guest. Children aged 6 and above are charged at the adult rate; younger children may stay at no extra charge, though an extra bed or crib is available on request for an additional fee.
From time to time, we may offer promotions, packages, discounted rates, or special events (for example, seasonal ski packages or festive dining offers). Such promotions may be subject to additional terms and conditions specific to that offer, including eligibility criteria, blackout dates, minimum stay requirements, or non-refundable/non-amendable rate conditions, which will be presented to you at the time of booking or participation. In the event of any conflict, the specific terms of the promotion will prevail over these general Terms to the extent of the inconsistency.
4. Room Rates and Local Taxes
Room rates are charged per room, per night and may include or exclude meals and add-ons as stated in the booking flow. The final price and included items will be shown before purchase. Consumption tax and other charges will be treated as displayed in the booking flow. Any accommodation tax or similar local levy imposed by law may be collected separately at booking, before arrival, or at the hotel, including the Hakuba Village accommodation tax applicable from 1 June 2026, unless the booking flow expressly states that it is included.
We accept payment by American Express, Visa, Mastercard, Diners Club, and JCB, as well as cash on-site. Where an extra bed or crib is requested for a room, this is subject to availability and an additional charge, which will be quoted separately from the room rate and confirmed at the time of booking or check-in.
We may require advance payment, a security deposit, or a payment-card pre-authorisation before or at check-in. By providing a payment card, the cardholder authorises the Hotel, to the extent permitted by applicable law and card-network rules, to charge all amounts properly due in connection with the booking or stay, including accommodation charges, taxes, cancellation and no-show charges, food and services, additional occupants, smoking or specialist cleaning, damage, missing items or keys, and other unpaid charges. The Hotel may retain a deposit or pre-authorisation until all such amounts have been determined and paid.
5. Check-in and Check-out
Check-in is from 3:00 PM to 7:00 PM, and check-out is by 10:00 AM. Guests must provide the Booking Confirmation, valid photo identification, and any payment card, deposit, or pre-authorisation reasonably required by the Hotel. We may refuse check-in where the named primary guest is absent, identity cannot be verified, payment requirements are not met, or refusal is otherwise permitted by law. Late arrival must be notified in advance. We may treat a booking as a no-show and release the room in accordance with the applicable rate conditions. No refund is due for early departure or unused nights except where required by the rate conditions or mandatory law.
6. Changes, Cancellations and No-Show Policy
Changes, cancellations, no-shows, and early departures are governed strictly by the rate conditions displayed before purchase and repeated in the Booking Confirmation. Non-refundable bookings remain payable in full. Unless the applicable rate conditions expressly provide otherwise, no refund or credit is due for a no-show, late arrival, early departure, reduction in occupancy, or any service not used for reasons attributable to the guest. Cancellation and related charges are payable in full, subject only to any limitation that cannot lawfully be excluded. Any refund that is required will be returned to the original payment method, and the Hotel is not responsible for third-party fees, exchange-rate movements, bank processing times, or other amounts outside its control.
7. Special Requests
Special requests, including dietary, allergy-related, medical, mobility, accessibility, room-location, bedding, or arrival requests, are subject to availability and are not guaranteed unless expressly confirmed by the Hotel in writing. Failure to fulfil an unconfirmed request does not constitute a breach and does not entitle the guest to cancel, obtain a refund, or claim compensation. We will provide accommodations required by applicable law, but may decline requests that are unsafe, unlawful, impossible, or would impose a legally excessive burden. Guests must provide accurate information reasonably necessary for the Hotel to assess a request.
8. No Smoking Policy
Shakespeare Hotel maintains a strict no-smoking policy throughout the premises except in any area expressly designated for smoking. If a guest or visitor breaches this policy, the Hotel may require the conduct to stop, terminate the stay, require the guest and party to leave, and withhold any refund to the extent permitted by law. The guest is liable for all reasonable cleaning, deodorising, restoration, damage, and room-loss costs arising from the breach, and authorises the Hotel to charge those amounts to the payment card or deposit provided, subject to applicable law and payment rules.
9. Guest Conduct and Restrictions
Guests must not bring pets, unauthorised visitors, their own bedding, hazardous materials, weapons, illegal substances, or electrical cooking or heating appliances into the Hotel unless expressly permitted. This restriction does not apply to assistance dogs or other accommodations required by applicable law. The Hotel may refuse entry to, remove, disable, or securely store prohibited items where reasonably necessary for safety, security, hygiene, legal compliance, or protection of Hotel property.
Guests and their visitors must not endanger or seriously disturb other guests or staff, damage property, engage in unlawful conduct, exceed authorised occupancy, interfere with Hotel operations, or use the premises contrary to the accommodation contract or Hotel rules. Where permitted by law, the Hotel may immediately restrict services, remove a visitor, require a guest and party to leave, terminate the booking without refund or compensation, contact law enforcement, and recover resulting losses and costs. The Hotel may take urgent protective action without prior warning where reasonably necessary for safety, security, or prevention of damage.
10. Damage to Hotel Property
The primary guest is jointly and severally responsible with each relevant member of the party for loss, damage, theft, specialist cleaning, excessive use, unauthorised occupancy, or loss of room revenue caused intentionally or negligently by the guest, any member of the party, or any visitor. The Hotel may recover the reasonable cost of repair, replacement, restoration, cleaning, investigation, and resulting loss of use. The guest authorises the Hotel to apply any deposit and charge the payment card provided after departure for such amounts, subject to applicable law and payment rules. The Hotel may provide an explanation or supporting information on request, but need not delay urgent repair or recovery action.
11. Right to Refuse Accommodation
The Hotel may refuse to conclude an accommodation contract or may terminate an existing contract on any ground permitted by the Hotel Business Act, applicable regulations, Nagano Prefecture or local ordinances, or other law. This includes, where the legal requirements are satisfied, lack of available accommodation; a request or intended stay contrary to law or public order; specified infectious-disease risks; violent, threatening, abusive, or repeated unreasonable demands; serious disturbance to other guests; organised-crime involvement; natural disaster or facility failure; material breach of the accommodation contract or Hotel rules; or any other legally recognised ground. Where required by law, the Hotel will record or explain the ground for refusal or termination. Termination does not affect the Hotel’s right to payment, damages, or other remedies to the extent permitted by law.
12. Optional Facilities — Luggage Storage
Luggage storage is offered only at the Hotel’s discretion and may be refused for dangerous, illegal, perishable, fragile, inadequately packed, unusually large, or high-value items. Valuable items, cash, negotiable instruments, jewellery, electronics, documents, and items of special importance must not be left unless specifically declared and expressly accepted in writing. To the fullest extent permitted by law, the Hotel is not responsible for loss, theft, delay, deterioration, or damage unless caused by its intentional misconduct or gross negligence; any liability is limited to direct, proven loss and excludes consequential or sentimental value. Unclaimed luggage and lost property may be stored, transferred, reported, sold, destroyed, or otherwise disposed of in accordance with applicable law, with storage and disposal costs recoverable from the owner where permitted.
13. WiFi Terms and Conditions
If the Hotel provides WiFi, access is provided as a discretionary convenience without any guarantee of availability, speed, compatibility, privacy, or security. To the fullest extent permitted by law, the Hotel is not liable for interception, malware, data loss, unauthorised access, service interruption, or other loss arising from use of the network. Guests must protect their own devices and must not transmit confidential information without appropriate safeguards.
Guests must not use the network for unlawful, infringing, abusive, defamatory, obscene, fraudulent, security-compromising, excessive, or commercially disruptive activity. The Hotel may monitor network performance and security to the extent permitted by law and may block content, restrict bandwidth, suspend access, disconnect devices, or report activity to authorities without notice. The guest is responsible for claims, losses, and costs caused by the guest’s misuse of the network.
14. Unable to Provide the Contracted Room
If, for a reason attributable solely to the Hotel, we cannot provide the confirmed accommodation, the Hotel may offer substitute accommodation of a reasonably comparable standard. If no substitute is offered or accepted, the Hotel’s liability will be limited to refunding the amount actually paid for the affected accommodation, and that refund will be the guest’s sole contractual remedy except to the extent a further remedy cannot lawfully be excluded. Where the inability results from circumstances beyond the Hotel’s reasonable control, the Hotel may cancel or modify the booking without further liability, subject to refunding any amount that applicable law requires to be refunded.
15. Liability and Guest Property
Guests remain responsible for securing their own property and maintaining appropriate travel insurance. To the fullest extent permitted by law, the Hotel is not responsible for loss of or damage to property left in guest rooms, vehicles, common areas, storage areas, or elsewhere on the premises unless the property was expressly accepted into the Hotel’s custody and the loss was caused by the Hotel’s intentional misconduct or gross negligence. Special rules may apply to deposited goods under mandatory law; valuable items must be declared and accepted as stated above.
The Hotel is not responsible for delay, interruption, cancellation, closure, reduced services, or failure caused by circumstances beyond its reasonable control, including natural disaster, avalanche, severe weather, fire, epidemic, government action, transport disruption, utility or communications failure, labour dispute, supply shortage, equipment failure not caused by the Hotel’s negligence, or other force-majeure event. The Hotel may take any operational measure it reasonably considers necessary in response, including changing facilities, services, room allocation, or check-in arrangements.
Nothing excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from the Hotel’s intentional misconduct or gross negligence. Subject to that exception and to the fullest extent permitted by law, the Hotel is liable only for direct and reasonably foreseeable loss caused by its proven breach, and its aggregate liability arising from a booking or stay will not exceed the amount paid to the Hotel for that booking. The Hotel is not liable for indirect, consequential, special, punitive, or economic loss, or for loss of enjoyment, opportunity, profit, data, or anticipated savings.
16. Guest Responsibility
The primary guest is responsible for the conduct and compliance of all members of the booking party, minors, and visitors, and is jointly and severally liable with them where permitted by law. To the fullest extent permitted by law, the guest shall indemnify and reimburse the Company, its affiliates, officers, employees, agents, and service providers for all claims, liabilities, losses, property damage, personal injury, penalties, and reasonable costs (including legal and enforcement costs) arising from the guest’s or party’s breach, negligence, intentional act, unlawful conduct, infringement of third-party rights, or misuse of Hotel property or services. This does not apply to the extent a loss was caused by the Company’s intentional misconduct or gross negligence or cannot lawfully be allocated to the guest.
17. Governing Law and Jurisdiction
These Accommodation Terms and Conditions are governed by the laws of Japan. Subject only to any mandatory jurisdiction rule that cannot be excluded by agreement, the courts having jurisdiction over the location of the Hotel shall have exclusive jurisdiction over any dispute arising from or connected with a booking, stay, or these Terms.
18. Changes to these Terms
We may amend these Accommodation Terms and Conditions from time to time; the version in effect at the time of your booking will apply to that booking. These Terms are supplemented by our Privacy Policy and Cookies Policy, and by any internal rules and regulations specific to the hotel.
These Accommodation Terms and Conditions are written in English. Where they are translated into Japanese or another language, including for use in guest-facing materials such as the registration card, the English version shall prevail in the event of any inconsistency.
